ミャンマーでは、これまで知的財産権が公的な知財法によって保護されてこなかったが、2016年には制定されるのではないか、との期待がある。現在保護を受けるためには、ヤンゴンの権利・保証登録官室で所有権宣言を登録する必要がある。 今まで所有権宣言の登録では登録人の簡単な署名だけでよかったものが、本年6月1日より、所有者宣言の有効性を高めるため（1）公証人認証済みでミャンマー大使館または領事館で認証を受けた委任状、（2）公証人認証済みの所有者宣言書、（3）商標見本（300DPI のJPG）、が必要になった。
（本文） Intellectual Property right in Myanmar has not been yet protected by an official IP law, which is desired to be enacted in 2016. Therefore, IPRS are currently registered under the Registration Act by filing a Declaration of Ownership at the Office of the Registrar of Deeds in Yangon, Myanmar (ORD).
New requirement for Declaration of Ownership Previously, to obtain the protection for an Intellectual Property right in Myanmar , the Declaration of Ownership is only required to be executed by a simple signature of the Applicant. However aiming to strengthen the validity of the Declaration, as from June 1st, 2016, a Declaration is additionally required to be certified by a notary public.
Anyone who are proceeding with the execution for Intellectual Property right in Myanmar, please take note for a sufficient materials preparation.
Summary required document as from June 01, 2016. (i) A Power of Attorney, which should be executed by a legal representative of Applicant, then certified by a Notary Public, finally legalized at Myanmar Embassy or Consulate in another country; (ii) A Declaration of Ownership, which should be executed by a legal representative of Applicant, then certified by a Notary Public (the same person, who signed on the Power of Attorney is recommended); (iii) A specimen of the trademark in JPG. file with resolution at least 300DPI.
Legalization by Myanmar Trade Office in Taiwan Due to the fact that the Myanmar Embassy in Taiwan has not been established, Taiwanese Applicant may find it difficult to legalize their document in the event of requesting protection for an Intellectual Property right in Myanmar . Under the circumstance, the ORD is considering to accept the documents, which may be previously verified at Myanmar Trade Office in Taiwan. Some successful precedents are reported.
